9 Michigan businesses fined for lack of COVID precautions – most following employee complaints

Nine other Michigan companies have been named and fined by the Michigan Occupational Safety and Health Administration for failing to follow required COVID-19 protocols.

Since MIOSHA began citing organizations for a lack of pandemic precautions, 44 have been fined. Most of the nine in this cycle stemmed from complaints filed by company employees, according to a Friday, Dec. 4 MIOSHA press release.

All fines are for violations of the MIOSHA “general rights clause”, which can result in penalties of up to $ 7,000. If the companies agree to resolve the issues within a specified time and agree not to appeal, the fine is reduced by 50%.

Violations: lack of adequate training regarding the risks, measures taken to protect employees, including site specific measures, and how employees can protect themselves, failure to regularly clean all frequently touched surfaces, failure to provide workers and visitors with paper towels to wash their hands and maintain hand sanitizer. The inspection was initiated by a complaint from an employee.

Tawas Bay Beach Resort

Location: East Tawas

Fine: $ 1,500

Violations: Lack of preparedness and response plan, failure to train employees on COVID-19, to assume and not to ask if customers not wearing masks were not medically able to tolerate a mask, and not to keep everyone on the premises six feet from each other. The employer was also cited for a non-serious record keeping violation. The inspection was initiated by a complaint from an employee.

The inspection was initiated as part of the COVID-19 Retail State Emphasis program.

Fine: $ 400.00

Violations: lack of preparedness and response plan, failure to train employees on COVID-19, lack of daily COVID-19 self-testing protocols and failure to display signs advising customers not to enter they are or have recently been ill. The inspection was initiated by a complaint.

Violations: The lack of face coverings when employees were within six feet of each other, allowing barriers in break rooms to be removed so that employees can sit next to each other and not to avoid larger meetings when social distancing was possible. Violations: Lack of face coverings worn for customers, failing to close waiting areas while customers wait for tables and not avoiding large gatherings. The inspection was initiated following a complaint from an employee.

Violations: Lack of a COVID-19 preparedness and response plan, lack of training of employees on policies to reduce the spread of COVID-19, failure to self-test for employees and not to apply face masks and social distancing. The inspection was initiated following a complaint from an employee.
