Emmanuel Aranda, 24, is charged with attempted first degree murder in the April 12 attack. Prosecutors said the boy was waiting with his mother in front of the Rainforest Cafe when Aranda grabbed the child and threw him over the railing.

Prosecutors say that "Aranda was looking for someone to kill" at the mall after being repulsed by women he had approached there. The boy suffered massive head trauma and fractures.

Family lawyer Stephen Tillitt said the boy was still hospitalized in critical condition and his family was asking for confidentiality.

"They must be able to focus their energy, their emotions and their minds on their son," he said. "I've heard that every new day is a good day."

Tillitt said he was not allowed to discuss details of the boy's injuries, and added that the family was grateful for the financial support received.

A GoFundMe campaign raised more than $ 700,000.
