In the spring of 2018, Matt Duffer and Ross Duffer, creators of "Stranger Things," were sued for allegedly stealing the idea from the hit series Netflix. Filmmaker Charlie Kessler claimed that the Duffer brothers had pulled a central point of the plot for "Stranger Things" from his short film Montauk. Kessler's case against the Duffer Brothers is now going to a jury trial after a judge dismissed the Duffers' motion for summary judgment, The Hollywood Reporter reports and pitchfork can confirm. The records of the Los Angeles County Superior Court, consulted by Pitchfork, indicate that the trial is currently scheduled to begin on Monday, May 6.
In his initial trial, Charlie Kessler stated that he and his agents had launched Montaukseries inspired by the Duffer brothers, who apparently did not show any interest. A lawyer from the Duffer brothers later claimed that his clients had "shown no intention of concluding a binding agreement" with Kessler and had described Kessler's claims as "baseless".
Interviewed today by Pitchfork, a spokesman for Netflix responded, "The Duffer brothers are receiving our full support. This case is unfounded and we hope to be able to confirm it with a full hearing of the facts in court. "
S. Michael Kernan, Kessler's attorney, told Pitchfork: "Now that the judge has ruled and dismissed their application for interim relief, we can now dispense with the nonsense promoted by the Duffers and Netflix that this suit is unfounded. and they had the "proof" that they had created the show. If the trial was unfounded, or if they had "evidence", they created it, so their summary judgment would have been a winner. They lost. It is very difficult to fight against these motions and winning this motion shows that Mr. Kessler has a good cause. We are eager to prove Mr. Kessler's case at trial. "
Pitchfork solicited comments from the Duffer brothers' lawyers.
