Kevin Federline complains about altercation between his son and Britney Spears' father

Britney Spears 'ex-husband Kevin Federline has obtained a no-contact order against pop singer Jamie Spears' father, according to Federline's lawyer. Los Angeles divorce attorney, Mark Vincent Kaplan, told NBC News that the order restricted access to Sean Preston and Jayden James and included geographical restrictions, including at home and at school.

The restraining order is still under seal and has not been seen by NBC News yet.

The order came after a physical altercation that occurred between Kevin Federline's son, Sean Preston and Jamie Spears on Aug. 24 at Spears' home in Ventura County, Kaplan said. Federline claims that Spears broke a door to reach his grandson and caught him once in the room, according to his lawyer. There were no blues or visible injuries in the child.

"There was a disagreement when Britney and the children were visiting Jamie at home, which resulted in a physical altercation by Jayden," says Kaplan. "Britney did the right thing, kidnapped the kids and took them out of there, but the trauma to the kids is still there."

Kaplan said he accompanied Federline to the Ventura County Sheriff 's post the next day, August 25, to file a police report to obtain an emergency protection order for her two sons with Britney Spears. Kaplan says that they are trying to fix the problem, they decided not to hold hearings on the evidence relating to domestic violence order made against Jamie after warning Britney's lawyers.

Sgt. Marta Bugarin of the Ventura County Sheriff's Office told NBC News that the allegation had been filed as a child crime. The case was submitted to the Ventura County Prosecutor's Office and prosecutors are investigating Jamie Spears' allegations of child abuse against Jamie Spears on August 24 in order to to determine whether criminal proceedings should be instituted.

The representatives of Jamie and Britney Spears did not immediately respond to a request for comments from NBC News.

Federline and the boys "are doing well," said Kaplan.

"It was important to Kevin that regardless of this event, the children have always had meaningful and ongoing contact with their mothers," he said. "Britney exercised proper parenting by removing her children from a dangerous situation."

The alleged incident prompted Federline and Kaplan to file documents on August 28 to formally adjust the former 50/50 couple's previous custody arrangement. Currently, Federline has custody of boys for "more than 90%" of the time, an arrangement that, according to Kaplan, has been unofficially in place for almost a year.

Despite reports that the new custody agreement grants Britney Spears unsupervised access rights, Kaplan said "the guard remains under surveillance."
