Carol Burnett seeks custody of grandson over daughter’s drug addiction

Comedy legend Carol Burnett is seeking custody of her grandson, Dylan, due to her daughter Erin Hamilton’s continued battle with drug addiction.

“Due to addiction issues and other circumstances with which my daughter, Erin, is struggling to impact the dynamics of her immediate family, my husband [Brian Miller] and I asked the court to be appointed legal guardian of my 14-year-old grandson, ”Burnett, 87, told Page Six in a statement Thursday.

“The guardianship will be for the purpose of monitoring his health, education and well-being and is not intended to prevent either he or the parents from a proper visit with each other,” the statement continued. “We look forward to the recovery being the next stepping stone to standardization and at this point we ask to respect confidentiality to allow this process to happen.”

Court documents – obtained by The Blast – indicate Burnett and Miller are only asking for temporary custody.

“Throughout her adult life and since Dylan was born, Erin suffered from serious substance abuse issues,” the site says. “For the past 19 years, Erin has been in and out of rehab centers and has been institutionalized a total of eight times for at least 30 days each time.

“Dylan’s living environment has long been unstable, unpredictable and unsanitary for a child. This culminated in a Department of Children and Family Services (DCFS) investigation and juvenile addiction proceedings in 2018 and 2019, ”the file says, according to The Blast.

The file reveals a host of details about the struggle of Erin, 52. In July, Hamilton was taken into involuntary psychiatric detention following an attempted suicide; Burnett contacted the LAPD for a checkup. Dylan’s father Kurt West recently signed up for drug rehab, the record also reveals, and the Department of Children and Family Services investigated the family in 2018 and 2019.

Hamilton, who is Burnett’s youngest daughter, is a singer who has landed several hits on the US dance charts, including two number one in 2008. Dylan, born in 2006, is the younger of her two children; his eldest, Zach, was born in 1997.

Burnett’s eldest daughter, Carrie, also suffered from drug addiction before becoming sober before her 18th birthday. (Burnett’s third daughter is Jody, 53.) “When we have [Carrie] in a third rehab, oh she hated my guts, ”Burnett told AARP magazine. “You have to love them enough that they hate you.” Carrie died of cancer in 2002 at age 38.

In 2019, the Hollywood Foreign Press Association created a Golden Globe Award in Burnett’s name for his television career. Steve Carell presented the inaugural statuette to Burnett.
