Court of appeals overturns order delaying execution of Lisa Montgomery

A federal appeals court paved the way for the execution of the only woman on death row in the closing days of the Trump administration.

In a decision released Friday, a three-judge panel of the District of Columbia Court of Appeals overturned a stay of execution granted to Lisa Montgomery last week.

The so-called “belly pillager” faces the death penalty again for her conviction in 2007 for strangling a pregnant woman to death in Missouri, then cutting her unborn baby from her womb.

Montgomery is set to be put to death on January 12 – although his lawyers have said they will request a full review from the appeals court.

Montgomery will be the first woman executed by the federal government in almost 70 years.

She was originally scheduled to die by lethal injection on December 8 at the US Penitentiary in Terre Haute, Indiana.

But in November, a federal judge temporarily blocked Montgomery’s execution after his lawyers contracted COVID-19 while visiting him in a federal lock-up.

Last week, the same judge issued an order staying Montgomery’s postponed execution date. The panel ruled on Friday that U.S. District Court Judge Randolph Moss erred in doing so.
