Supreme Court orders the killing of Lisa Montgomery

The Supreme Court ruled Tuesday night that Lisa Montgomery “plunderer of the womb” must be put to death, a day after a federal judge in Indiana suspended her execution because of her mental health.

the six votes against three, means Montgomery will become the first woman to be executed by the federal government in nearly 70 years.

The move comes eight days before President Trump, who has been executing for the past year, leaves office. President-elect Joe Biden categorically opposes the death penalty.

Federal Judge Judge Patrick Hanlon on Monday blocked Montgomery’s execution citing deteriorating mental health.

“As stated elsewhere in this order, Ms. Montgomery was diagnosed with physical brain impairment and multiple mental illnesses, and three experts are of the opinion that based on the behavior and symptoms reported to them by the lawyer, Ms. Montgomery’s perception of reality currently distorted and weakened, ”Hanlon wrote in his ruling.

Montgomery was originally scheduled to die by lethal injection on December 8, but in November, a federal judge temporarily blocked his execution after his lawyers contracted COVID-19 while visiting him at the federal correctional complex in Terre Haute, Indiana.

In 2007, Montgomery was convicted of the murder of 23-year-old Bobbie Jo Stinnett in Missouri. She strangled Stinnett with a rope before cutting it and running away with the baby.
