Thomas Fee, retired New York firefighter, indicted in riot on Capitol Hill

A retired New York firefighter who photographed himself inside the US Capitol during the January 6 uprising and claimed he was “at the tip of the spear” has been charged with criminal charges, have the authorities announced Monday.

Thomas Fee, 53, was charged on Saturday with violent entry, disorderly conduct on the Capitol grounds and knowingly entering or staying in a building or restricted land without legal permission, according to a criminal complaint. The Freeport, Long Island resident has not been arrested.

Fee came to the attention of authorities after someone contacted law enforcement to report that her partner saw a post on Fee’s girlfriend’s Facebook page stating that he was in Washington DC for the pro-Trump rally that preceded the riot inside Capitol Hill.

The person texted Fee – a 22-year veteran of the New York Fire Department who retired in October – asking if he was in Washington. Fee responded that he was with a photo of himself in the Capitol Rotunda with suspected rioters in the background, authorities said.

He then sent a video recording of a crowd inside the building shouting “tyranny” and “Pelosi”, a reference to Speaker of the House Nancy Pelosi, prosecutors said.

After sending the video, Fee subsequently texted the person saying he was “at the tip of the spear”, according to court documents.

In a statement released last week, the New York Fire Department said it had received anonymous allegations that serving or retired members were present on Capitol Hill during the siege.

“The Department respects the right of all its members to take and personally support social and political positions,” FDNY Commissioner Daniel Nigro said last week. “Members of the ministry, whether active or retired, should not engage in conduct that tends to discredit the ministry or that disturbs the discipline and good order of the ministry.

In 2004, Fee was suspended from his volunteer firefighter job on Long Island after shouting racist slurs at a black doctor, the New York Post reported.
