Epic Games had wanted to depose Cook for eight hours, according to court documents. As Gizmodo reports, Apple’s lawyers attempted to get the CEO out of the deposition by citing top doctrine, before offering a four-hour compromise.
California judge Thomas S. Hixon said seven hours is the length of time “a witness must suffer to be testified”, adding that it would no longer be “unjustified”.
Apple also asked to assign internal documents to Samsung, but the request was denied. Apple wanted to prove that its App Store policies and practices are not unique to the company. Judge Hixon said that Epic Games’ agreement with Samsung “cannot serve as a substitute for a broader class of market players.”
Cook’s sworn, out-of-court testimony could be used in the lawsuit between Apple and Epic Games, which begins in May.
