A Texas judge ruled on Monday that the Bexar County mask warrant could remain in place, despite a Sunday decision by the Texas Supreme Court that sided with Texas GOP Governor Greg Abbott, who prohibits such warrants.
A day after the Texas high court upheld Abbott’s ban on mask warrants, State District Judge Antonia Arteaga approved the mask requirement for county public schools on Aug. 10.
“My thoughts continue to go to the children in our schools who do not have access to the vaccine but have to go to school associated with the dire situation right here in the hospitals in Bexar County, and where we are now. “Arteaga said of her decision, according to the Texas Tribune.
The mandate also applies to offices and buildings in the city and county of Bexar County, which includes San Antonio.
Arteaga’s decision is the latest in a series of legal challenges against Abbott’s July executive order banning local entities from implementing mask requirements.
While Abbott’s representation argues he has the right to enforce the Texas Disaster Act ban, a San Antonio and Bexar County attorney asserted that they were justified in overriding the order. Abbott under the Texas Health and Safety Code.
San Antonio Mayor Ron Nirenberg is said to have celebrated the victory but anticipates other challenges.
“We realize the battle is not over,” he told My San Antonio. “We expect the state to appeal the judge’s decision, and we will be there to defend our school children every step of the way.”
