Marijuana found on train before fatal shooting in Tucson

TUCSON, Ariz. (KOLD News 13) – Criminal complaint reveals more details about a incident that left a DEA agent dead and another injured with a city police officer at the Amtrak station in downtown Tucson Monday October 4.

According to federal documents, Devonte Okeith Mathis and a man identified as DT were on a train that stopped in Tucson around 8 a.m.

Tucson Police Chief Chris Magnus said members of the Pima County Counter Narcotics Alliance boarded the train to check for money, drugs and guns.

The agents, who followed a tip, had received a list of names, and Mathis and DT were on that list.

An officer said he saw Mathis stand up and pull several bags away from him. Asked about them, Mathis allegedly denied that they were his.

Officers said the bags were searched and more than five pounds of marijuana and 50 3.5-gram bags of edibles were found.

DEA Agents Mike Garbo and S. Fox returned to the train in search of DT and were shot dead. Garbo died while Fox suffered serious injuries.

An officer from the Tucson Police Department was part of the task force. Magnus said that upon hearing the shots, the officer with the initials PH jumped on the train and was hit. He was taken to a local hospital and is expected to recover.

Mathis was arrested as soon as the shots were fired. He faces a charge of possession with intent to distribute less than 50 kilograms of marijuana.

DT was gunned down after sacking another officer.
