A passenger carried bulk marijuana on a train before shooting drug enforcement officers to death in Tucson, Ariz. On Monday, investigators said.
A federal criminal complaint filed Tuesday in a United States district court alleged the Amtrak passenger had five pounds of “loose marijuana” and 50 packets of edibles, according to the New York Times.
The complaint did not identify the shooter by name, but provided new details on the sequence of events that led to the shooting.
As drug enforcement officers boarded, the passenger stowed the products away on the train and returned to his seat, the Times reported.
The shooter was seated across from Devonte Okeith Mathis, who was later charged with intent to distribute marijuana, according to the Times.
The complaint stated that Mathis had denied that a bag containing marijuana belonged to him. After this interaction, the officers approached the gunman who opened fire on them.
The shooting left one DEA agent dead, another seriously injured and a police officer hospitalized.
Officers were on the train investigating a tip they received from Amtrak. All 137 passengers and 11 crew on the train were safely evacuated, an Amtrak representative told The Times.
Arizona allows people over the age of 21 to consume an ounce of marijuana for recreational purposes. However, possession of marijuana remains illegal at the federal level. Drug trafficking is illegal at both state and federal levels.
