Foxx is recused from the Smollett case after it revealed that she was contacting one of the actor 's relatives during the investigation.
Smollett was behind 16 charges for disorderly conduct for allegedly orchestrating a hate crime hoax on a Chicago street in late January.
Smollett, who is black and gay, said in January that he had been skipped by two men who had shouted racist and homophobic slurs, as well as by the slogan: "This is MAGA country!" ;attack.
The 36-year-old "Empire" star claimed that his assailants had sprayed him with bleach, threw him a rope around his neck and hit him.
During his investigation, the Chicago police determined that Smollett organized the attack and paid for two brothers – both of whom played a minor role in "Empire" – to carry out the alleged beating.
