"I do not involve myself in sentencing cases," CND Schiff, a California Democrat, said on Monday about Cohen's request. "I have never been to Congress and that is my policy."
Cohen is expected to be sentenced to three years in prison on May 6, after pleading guilty to financial crimes, campaigning offenses and lying to Congress.
Cohen's lawyers wrote in last week's letter that he had only recently had access to a new hard drive containing millions of files that could be useful to investigators. They also argued that President Cohen's testimony in Congress demonstrated his cooperation in both judicial investigations and criminal investigations into President Donald Trump and his companies.
Earlier this year, in his testimony, Cohen accused Trump, for whom he had already been his long-time personal advocate, of financial fraud and of directing secret payments to women alleging facts.
"We hope this memorandum demonstrates that Mr. Cohen must be readily available and immediately available to provide ongoing assistance to Congress to enable him to fulfill his oversight responsibilities of the executive branch," the letter said. "However, with 30 days before he goes to jail, time is no longer a luxury of which he is capable."
Schiff said he was nevertheless interested in receiving new information from Cohen, regardless of his prison term.
"We continue to encourage Mr. Cohen to provide us with all documents related to our investigation," Schiff said. "We will continue to do so and hope that he will have other information to offer."
