The lawsuit filed Monday against the wrongful death indicates that Nicholas F. Immesberger had received excessive consumption of alcohol before the December 10 car accident.

Immesberger worked at Woods' Jupiter Restaurant, owned by Woods. The golfer's girlfriend, Erica Herman, is the executive director.

The lawsuit indicates that Herman recruited Immesberger as a bartender while he knew his condition. And it is said that the employees, managers and restaurant owners allowed this 24 year old man to be overwhelmed even though they knew he was an alcoholic.

The Woods agent did not respond to an e-mail requesting a comment.
