The district prosecutor's office said last week that Rivera was also accused of indecently assaulting another 16-year-old girl. This alleged assault had been discovered during the investigation regarding the 13-year-old girl.
Inspectors said he had left the 13-year-old girl at the Lawrence General Hospital on May 20. She died shortly after arrival. The cause and manner of his death have not yet been revealed, the prosecutor's office said.
According to the investigators, Rivera was accompanied by another girl, under the age of 16, when he dropped the 13-year-old man to the hospital. Inspectors said the two girls were at Rivera's apartment before the death of his 13-year-old son. On Wednesday, there is no charge against Rivera compared to the other girl who was with him that day.
The 13-year-old girl's mother told the Boston Globe that she had dropped off her daughter at a friend's house in Amesbury and was worried about not hearing from her. After sending text messages to her daughter's friends, the mother stated that she had learned that she had been taken to the hospital.
Rivera is being held without bail and is scheduled to appear in court for a probable cause hearing on July 2.
