A little more than a week after the Chicago police presented what appeared to be a prejudicial case against "Empire" star Jussie Smollett, a defense strategy is emerging – centered primarily on the discredit of the two men who named Smollett as the brain.

Police said that the case against Smollett had occurred at the last hour of their two-day interrogation on the Nigerian brothers Abimbola and Olabinjo Osundairo. But questions about the motives of the brothers and the evidence that prosecutors and police have said against Smollett are on the rise, defense sources said.

Smollett, who is openly gay, said his attackers used homophobic insults during the incident. Other actors in the "Empire" reported seeing at least one of the brothers making such comments to another cast member on the set of the series.

Tweets of several years containing allegedly homophobic comments from what appeared to be the story of Olabinjo Osundairo also surfaced, but were later deleted.

Smollett's defense should assert that the police said the payment of the hoax attack was actually a training to help Smollett prepare for a video clip shoot, sources said close to folder.

The images of the control obtained by NBC 5 show a memo line stating "5 week nutrition / training program (do not leave)". The check was dated January 23, six days before Smollett claimed to have been attacked in Chicago. Screen captures of text messages, confirmed as authentic by sources close to the record, also showed Smollett and one of the brothers a meal forum and a grocery list discussing a few days before the alleged attack.

Defense sources also report potential financial problems, the two brothers filed for bankruptcy in 2016.

There are also questions about the information originally published by the police in this case.

Supt. Eddie Johnson said that Smollett had misled investigators from the beginning by saying that at least one of his attackers was white. This key detail did not appear in the first police report, in a subsequent community alert or in Smollett's public statements. The detail was not made public for several days after the alleged attack.

The authorities claimed that Smollett had organized the attack because he was unhappy with his salary. The evidence surrounding this claim has not been revealed, but "Empire" producers have written Smollett's character among the last two episodes of the season in the midst of the ongoing investigation.

The lawyer of the brothers involved in the alleged alleged attack on Thursday issued a statement in which they declare to have a "deep regret for their involvement in this situation".

"They understand the impact this has had on the country's population, especially minorities and in particular victims of hate crimes," Gloria Schmidt said in her statement.

Smollett denies the allegations and has maintained his innocence.
