The ACLU on Tuesday filed an amicus brief in support of Britney Spears as the pop star tries to break free from a 13-year-old guardianship she called “abusive” in her testimony last month .
The ACLU filed the case, along with 25 civil and disability organizations, in support of Spears’ desire to choose his own lawyer, which is prohibited by the Guardianship. Spears’ court-appointed lawyer Samuel Ingham III resigned from the case last week. The brief, filed in Los Angeles County Superior Court, also requests that she have access to assistance and tools to make her selection for replacement.
“Britney Spears said she wanted to choose her own lawyer and that the court should respect that wish,” Zoë Brennan-Krohn, lawyer with the ACLU’s Disability Rights Project, said Tuesday. “The court should make sure Spears has access to the tools she needs to make that choice meaningfully and hire someone she trusts to defend her stated goal: to get out of her tutelage. Spears’ right to choose a lawyer is not only a basic principle of the Sixth Amendment right to counsel, but also conforms to the principles of personal autonomy and agency. The California Superior Court must recognize Spears’ autonomy and the rights of people with disabilities to lead independent and independent lives as active members of their community.
