A jury had to decide if Ed Sheeran had plagiarized a Marvin Gaye song

Ed Sheeran seems to be in a few legal problems.

In a new NME report, the singer is in the midst of a plagiarism lawsuit, where he would have been copied to Marvin Gaye's clbadic song, "Let's Get It On", with his song "Thinking Out Loud".

The singer asked the judge to file the plagiarism lawsuit against him, but a Manhattan district judge, Louis Stanton, then dismissed him.

Stanton would have found "substantial similarities between several musical elements of the two works".

He then explained that the jurors "may be impressed by the images of a Sheeran representation that shows it in seamless transition between [the songs]. "

To further refine his decision, the judge stated that he found "Thinking Out Loud" and "Let It Get On" to be the same or almost identical with respect to: aesthetic appeal, percussion and low.

Because of his decision, a jury is now needed to decide if Sheeran really copied the beloved song.

As Vanity Fair notes, the jury will have to determine whether the harmonic rhythm of Gaye's Let's Get It On is too common for him to enjoy copyright protection.

Depending on their decision, he will decide whether Sheeran breaks the clbadical song or not.

In addition, Sheeran challenged the lawsuit, claiming that Gaye's song was known as a "badual anthem," while his song was better known as "dark, melancholy tones, evoking a lasting romantic love."

Which, according to Sheeran, makes them seem different.

In any case, it's a story in progress and only time will tell if Sheeran wins or not the lawsuit.
