Alan Dershowitz: "The Mueller report should never have been written"

The report of special advocate Robert Mueller on the investigation in Russia should never have been written, according to Alan Dershowitz.

The Constitution does not explicitly provide for the presence of special advocates or special prosecutors, Dershowitz said Tuesday about "The Ingraham Angle".

He added that these offices were "inconsistent" with the founding document, adding that there was no claim to the conclusion of several hundred pages of the investigation into President Trump.

Dershowitz also claimed that the Democrats had no legal right to have Mueller testify before them.

"Prosecutors have the right to say only one thing: we concluded that there was no evidence sufficient to accuse the president of connivance or obstruction of justice by the Russians , a point is everything.I do not ask any question, I do not make public report .. give my findings to the Attorney General.

"No prosecutor should go beyond that."

Earlier on Tuesday, House Democrats had passed a civil enforcement resolution finding Attorney General William Barr and former White House lawyer Don McGahn contempt of Congress.

Barr had previously ignored a hearing on the findings of the Mueller report after Trump had claimed the privilege of the executive.

The news came just a day after a Democratic-led key committee postponed its own contempt vote and said the Justice Ministry was cooperating in its investigation.
