Amber Portwood is facing a new legal battle.

Andrew Glennon looking for custody of his one-year-old son and Amber, James Glennon, E! The news has learned. He filed a request for an urgent hearing concerning the paternity and custody of their child, just days after the release of his girlfriend.

The mother of two was put behind bars Friday after allegedly assaulting Glennon in their common home in Indiana. In a statement, the police informed E! News that officers were sent to Portwood at 3 am because they had received a call regarding a disturbance. When they arrived at the scene, a male victim stated that he and his living girlfriend had been involved in a disagreement that had turned into violence. The victim alleges having assaulted her by holding their baby at a young age.

This is not the first time that Amber would have beaten his partner. In 2010, she was arrested and charged with domestic battery for felony and negligence of a domestic battery of dependent and tort, after allegedly slapping and smothering the young fiance Gary Shirley in front of their toddler, Leah.

His ex has since spoken of Amber's recent arrest. He said: "My prayers accompany @AmberLPortwood, Andrew, and more importantly, baby James, do not identify any details, but I think of them."

He added, "And for all the questions and concerns, Leah is currently camping / camping with her best friend."
