This sentence results from the judgment of a guardianship in favor of the journalist Vanesa Restrepo, who in June 2019 reported to her bosses from the newspaper El Colombiano that she had been sexually assaulted by Juan Esteban Vásquez, a colleague.

Restrepo called for measures to be taken to protect his integrity during the course of criminal proceedings and for a clear institutional protocol to be designed for the prevention and management of cases of sexual and gender-based violence.

The newspaper says he never questioned the testimony of the journalist and denied that an environment of sexual harassment has been fostered in the workplace, which is why a process has been initiated to create a protocol for handling this type of case.

Thus, the Court ruled in favor of Restrepo and declared that the newspaper, originating in Medellín, by action and omission, had violated the fundamental rights of the mistreated journalist, because “he did not respect his duties to prevent, to investigate and punish violence against the woman who was the victim of the complainant, depriving her of a clear, faithful, reliable service and support path, with a differentiated and gender approach, and preventing her from taking advantage of ‘a dignified work environment, without re-victimization’.
