This Thursday, July 22, it was announced that the General Council of the National Electoral Institute (INE) fined Movimiento Ciudadano 28 million pesos for being the beneficiary of a financial triangulation of private companies, close to the elected governor of Nuevo León, Samuel García for an amount of 14 million pTo finance a large part of the campaign.
Jaime Rivera, adviser to the INE, specified that the investigations of the Technical Control Unit They confirmed that the 14 million pesos “had been received the day before, or the same day, from two companies Firma Jurídica y Fiscal Abogados and SAGA Tierras y Bienes Inmuebles, it is therefore clear that this money does not come from the money of contributing citizens, but from commercial companies, entities to which it is forbidden to give money to political parties ”.
It is, he said, a simulation or triangulation scheme to finance a party by entities prohibited by law.
Councilor Carla Humphrey expressed that she would accompany the project “Because it denotes the organization of an illegal funding model, simulating legal contributions through individuals, when the contributions come from persons of a commercial nature ”which are entities prohibited in the electoral law.
Likewise, he announced the issuance of a concurrent vote, considering that the project was not sufficiently exhaustive because it did not pronounce on the destination of the resources obtained by accredited triangulation.
In context, it was revealed that Samuel García’s campaign received 14 million 026 thousand 500 pesos of money prohibited by law, from the hands of Bertha Silvia Sepúlveda Andrade, Silvia Catalina García Sepúlveda and Roberto García Sepúlveda, who previously received the resources of the three companies mentioned in a system of triangulation.
The Citizen Movement (MC) will contest before the Electoral Tribunal of the Federal Judicial Power (TEPJF) the fine imposed on Samuel García for more than 400 thousand pesos and to the party 55 million 351 thousand 821.36 pesos for Instagram stories and photos published by Mariana Rodríguez, wife of the elected governor of Nuevo León.
“Movimiento Ciudadano does not share the criteria of the General Council of the National Electoral Institute (INE), which today decided to apply a millionaire’s fine for alleged financial irregularities in Samuel García’s campaign, and will challenge the decision before the Electoral Tribunal of the Federal Judicial Power “, the political group said in a statement.
On the other hand, MC explained that the publications used by Rodríguez during Samuel García’s campaign, they are messages of legitimate support and use of his freedom of expression.
“A similar scenario occurred in 2018, when the INE also intended that the publications that Mariana Rodríguez made on his social networks about Samuel García, then candidate for senator, ”they added.
At that time, the party stressed, “the Electoral Tribunal ruled in favor of Samuel García. He determined that these were publications protected by freedom of expression that did not create irregularities in inspection or an expense that should be reported. “
With eight votes for and three against, it was determined that during the elections, Both the party and the candidate at the time benefited from financial contributions in kind from the influence Mariana Rodriguez. This without having reported them correctly.
