The state of California has made it illegal to remove a condom during sex without verbal consent., a practice known in English as “stealthing” (stealth, in reference to doing something without the other person noticing).
The Governor of the West Coast State of the United States, Gavin Newsom, on Thursday signed a bill that classifies this practice as “Sexual assault”.
“By passing this bill, we are emphasizing the importance of consent.the governor’s office said in a tweet.
Cristina Garcia, a member of the California assembly that introduced the bill, said removing condoms without consent “is not only immoral, but illegal”.
California is the first state in the country to specifically ban this practice, which can expose victims to unwanted pregnancies or sexually transmitted diseases.
According to the bill, commits a sexual assault which “causes contact between a sexual organ, from which a condom has been removed, and the private part of another person who has not given verbal consent for the withdrawal of the condom”.
The practice of “stealth” sparked a debate in the United States after the publication of an article by a doctoral student, Alexandra Brodsky, in 2017 at Columbia Journal of Gender and Law.
Brodsky pointed out that there was online forums that provided information on how to do stealth, some of which were subsequently closed.
