Both cases fall under the macro-economic cause "Lava Jato", who examines a network collecting bribes in exchange for the award of public contracts that has sprinkled many politicians and businessmen.

Lula, president between 2003 and 2010, has already served his sentence since April for another case of corruption.

In the new case, Judge Hardt estimated that Lula had benefited from work for nearly one million reals (about $ 271,000) that three companies – Odebrecht, OAS and Schain – had made in a country house in Atibaia.

The house bears the name of businessman Fernando Bittar, an old friend of Lula 's family, who temporarily gave him to the former president in 2010 for that purpose. he can enjoy it with his family.

However, according to the law, even though he is not the owner of the country house, Lula illegally benefited from reforms undertaken in the same direction by companies favored by his government with contracts with the state oil company Petrobras .

In addition to Lula, Judge Hardt condemned some businessmen, including former OAS President, José Adelmario Pinheiro Neto (one year and seven months in prison); Emilio Odebrecht, patriarch of the Odebrecht group (3 years and 3 months in prison) and his son Marcelo Odebrecht (5 years and 4 months of detention).

This is the second sentence in less than two years against Lula, 73 years old and detained since April 7th.
