The complainants point out that the purpose would have been to force a renegotiation of the contract which resulted in an agreement, no opinion, balance sheet or economic financial report on the operation of Ausol by the authorities, subject to the payment of $ 499 million to the the applicant

The complaint lodged by Tailhade, Adrián Grana, Carlos Castagneto and Leopoldo Moreau states that the said "arrangement constitutes a dispossession of the public patrimony which must be the subject of an investigation by the criminal justice system". Neither the general director of National Highway from December 2015 to June 2018, Javier Iguacel, nor the Minister of Transport from December 2015 to date, Guillermo Dietrich, have ordered the slightest measure of defense of the national state to counter Ausol's claims, presented through the intermediary of its parent company Abertis prior to ICSID. "The request was only to justify the triggering of the renegotiation of the concession contract, whose completion was in progress in 2020," the complainants stress.

In response to this request, "without there being any opinion, audit or economic financial report on the operation of Ausol, and dismissing the many defenses that can be argued before the ICSID, Dietrich and Iguacel have taken steps to set the amount of $ 499 million, "reports the denunciation of the members of the FpV.

"I have no doubt that this $ 500 million was shared between the company and the officials," said Tailhade. The presentation before ICSID, he added, "only worked as a façade to justify a payment that could have no legal or economic support of any kind". The process of "settlement" of the ICSID trial resulted in an increase in the listing of Ausol shares – given the possibility of recovering a significant portion of the claim – of 400% from the badumption of responsibility from Macri until mid-2017, when the Socma group decided to sell its stake.

The complaint was filed in Federal Court No. 6 by Rodolfo Canicoba Corral, with the intervention of the Prosecutor's Office 4 of Carlos Stornelli. The plaintiffs announced that they would ask the judge to separate Stornelli from the investigation, based on the latest known public episodes around the so-called "Alessio case", which testified to the proximity and the Prosecutor's friendship with President Macri. , imputed in this complaint.
