A judge who must try Cristina Kirchner, and whom they want to move, has addressed the Supreme Court

Before the Supreme Court of Justice, the highest court criticized by Minister Martín Soria and by President Alberto Fernández himself, Judge Germán Castelli – whom Kirchnerism sought to displace – presented a brief asking be left definitively as a member of the Federal Oral Tribunal 7 (TOF 7) que must conduct the trial of the Cuadernos de las Bribes affair. The magistrate spoke of a violation of the division of powers and maintained that the “sensitive cases for which he is responsible” are the reason why they sought to remove him from his functions.

TOF 7 was one of the last to be created and was complete, until Germán Castelli was included in the list of ten judges who, at the discretion of the Judicial Council – with a Kirchner majority -, they had been transferred irregularly to their posts.

More than twenty days ago, the Federal Administrative Court of Appeal ruled that Castelli should remain in office temporarily, exactly as the Supreme Court of Justice had ruled. That is to say his place must be contested and covered by a titular judge.

The proposal was considered by the member of TOF 7 as an “idiot of justice whose gravity is also given by tending to generate a forced dismissal”. For this reason, Castelli presented a brief on Monday to the Supreme Court of Justice, at the center of the main criticisms of the government.

“I am a natural judge in sensitive matters filed before the said court of national and international public repercussion, in respect of some of which the President of the Nation himself ruled for the innocence of his running mate, indicted in various processes (which resulted in the repeated request for resources to this Court for the provision of an adequate justice service in accordance with the National Constitution, which was already verified in the decisions of this Court dated 29/09/20 and 5.11.20 “, he said. he indicated in the brief to which he subscribed Bugle.

In another section of his appeal, Castelli said that the highest court should be that which would reverse “the unstable and therefore dangerous consequences for the republican system of judgment” involved. Castelli understands that the Court must intervene “urgently, in order to adjust its scope according to the limits imposed by the national constitution “.

During the analysis of the situation, which began with the proposal of the Kirchnerist-majority Judicial Council and which resulted in the vote in Congress for their trip, as well as that of the chambermaids Leopoldo Bruglia and Pablo Bertuzzi, Judge Castelli noted in his brief that “if the maneuver is successful, it would result in the dismissal of the undersigned natural judge of the open processes followed by the current Vice-President of the Nation, among others, on whose innocence the President had publicly ruled “.

At the time, the magistrate maintained that it was not by chance that the Congress, chaired by Cristina Kirchner, advanced on its position “because there is a relevant case before the Court of which the main defendant is the vice-president” . He still maintains it: in his opinion, there is a political intention to move him.

In addition to the Cuadernos case, whose oral trial will begin when dozens of previous proposals and procedures are approved, TOF 7 also has cases against former army chief César Milani, former minister Julio De Vido and actress Andrea del Boca.
