Astudillo Castro: order to raid again the police station where he was last seen

The Federal Chamber of Bahía Blanca on Friday ordered a new raid on Lieutenant Origone’s police station where Facundo Astudillo Castro was intercepted, on April 30, and hijack the phones of the police officers who were with the young man before his disappearance. It happened hours after prosecutors challenged the judge for loss of impartiality.

The decision of chambermaids Pablo Larriera and Leandro Picado led to an appeal and partially overturned the decision of Federal Judge 2 of Bahía Blanca María Gabriela Marrón, who on October 15 rejected the evidence requested by the prosecution and the complaint.

In this way, the judges ordered a new search of Lieutenant Origone’s police station and the hijacking of phones, personal and official, troops who had contact with the young man before his disappearance, reported the Provincial Commission of Memory (CPM).

Meanwhile, prosecutors Horacio Azzolin and Andrés Heim arrested Judge Marrón on the grounds that he lost the impartiality he must have to move the case forward and requested that their decision to order a measure of proof be declared void, as the judicial authorities understand that it is a interference with the private powers of prosecutors.

Prosecutors had ordered a tidal survey last October on the estuary where the young man’s body was found, between April 30 and September 12.

As emerged on Tuesday of last week, the Argentine Institute of Oceanography (IADO), the Naval Hydrographic Service (SHN) and the Center for Renewable Natural Resources of the Semi-Arid Zone (Cerzos) presented a relation which, according to Azzolin and Heim- had formal irregularities, therefore Last Friday they ordered the realization of a new one.

That same Tuesday, the OIA presented yet another document, with unusual features for prosecutors, since it was fieldwork carried out without authorization from investigators or control of the parties and, in turn, argued a hypothesis and came to conclusions. request.

In this context, last Wednesday, Judge Marrón ordered the IADO to carry out another field study on the Bahía Blanca estuary, considering that it was complementary to the autopsy she had ordered, while stressing that this request did not imply the resumption of the investigation of the case.

In view of this request, Azzolin and Heim considered that this magistrate’s decision was void and they asked for it in a presentation, in which they argued that “within the framework of the delegated instruction, the judges are veiled to adopt measures ex officio, because they undermine the independence of the public prosecutor (…) and violate the right to treat “.

Likewise, they noted as erroneous the judge’s statement that such a decision did not imply the resumption of the investigation. On the contrary, they understood that, when a magistrate acts in this way, he in fact takes control of the investigation of the case.

In addition to nullity, Prosecutors argued that Marrón’s decision to force the completion of this study involved crystallizing his position on: In other words, Astudillo Castro accidentally drowned after attempting to cross the Bahía Blanca estuary on foot.

Accordingly, Azzolin and Heim argued that this attitude implies the loss of the impartiality owed to all judges and, subsequently, they demanded his withdrawal from the case.

Facundo was last seen on April 30 when he left his home, located in the Buenos Aires city of Pedro Luro, in quarantine due to the coronavirus, heading to Bahía Blanca to see his girlfriend, with who he had argued. The young man was intercepted by the police for violating preventive and compulsory social isolation and, subsequently, was not heard from until August 15, when his remains were found in a crab in the city of General Daniel Cerri.

His mother and lawyers are convinced of the responsibility of the police in what happened with Facundo, who, according to the autopsy, died of suffocation from submersion.
