A New York woman mistakenly consented to foreigners being displaced because the man had mistakenly been identified as his brother, a report said on Monday.

Shirell Powell sued a Bronx hospital that last July contacted a dying family member.

The man, who bore the same name as the woman's brother, had a tube in his mouth and his face swollen.

Powell, who spent nine days with the patient at the hospital, said her sister initially had doubts, but both decided that the facial features were those of the brother.

The medical examiner correctly identified the identity of the man later.

Frederick Williams, the brother, was in prison. Williams said to the New York Post that he is not angry at his sister, but with the sufferings of his family.

St. Barnabas Hospital states that this request is unfounded.
