Kirchnerism progresses in the control of a strategic place for the causes of corruption

The executive branch submitted to the Senate the document Roberto Boico -who was lawyer for Cristina Kirchner and Oscar Parrilli-, to join the Federal Chamber porteña. The Federal Chamber of Buenos Aires, which operates on the second floor of Comodoro Py, is made up of two chambers with three judges each. Today, only one of them is fully integrated, but two of its judges -Bruglia and Bertuzzi-, are dismissed by order of the Supreme Court, temporarily, that is to say until the challenge corresponding is justified.

These two judges were at the center of the debate last year, when Kirchnerism felt that their transfers in 2018, under the leadership of Mauricio Macri, had not been made within the framework of the requirements of the law. However, the procedure, although it did not go through Congress for its approval, was recognized by a concerted decision of the Supreme Court of Justice.

The ruling party’s proposal started at the Judicial Council, responsible for appointing judges, and led to the dismissal of the two chambermaids until the Supreme Court ordered their return to office, but no longer definitively . The competitions must take place, which the body chaired by Alberto Lugones quickly launched. Statistics indicate that the appointment of a judge – according to official data – it takes about three and a half years; now they will seek do it in six months.

The importance of the Appeals Chamber lies in its role in the face of investigations promoted by prosecutors and first instance judges of Comodoro Py. Each treatment issued, each asset decision adopted, as well as the evidentiary measures ordered in the context of a case, are examined by this higher body. These are, for example, Bruglia and Bertuzzi who confirmed the charges against Cristina Kirchner and her former officials, in the case known as Bribes notebooks.

This week, the Government published in the Official Journal the formalization of Judge Farah’s return to the Chamber. He was one of the order makers at the time, the release of Cristóbal López and Fabián de Sousa in the event that the alleged fraud of $ 8,000 million to the state is investigated, for the tax on fuels that were not paid with the petroleum signature.

According to decree 53/2021, the Judicial Council granted the magistrate’s request for reinstatement “taking into account the judge’s express declaration that he has no interest in participating in the competitions aimed at filling vacancies for which he was transferred “.

After this controversial 2018 decision, Farah requested his transfer to the Judicial Council. He first applied to an oral court in economic criminal matters, then to the Federal Oral Court 2 in San Martín.

Now the executive branch has sent Boico’s declaration to Congress to enter the Federal Chamber of Comodoro Py. Today he is Oscar Parrilli’s lawyer, and he was also legal counsel to Cristina Kirchner in the case that started with the late prosecutor Alberto Nisman’s complaint about the pact with Iran.

In this way, Kirchnerism progresses with nominations at a key location in Comodoro Py. Boico will join Chamber II of the Chamber, where Judge Martín Irurzun is located, criticized by the ruling party when he established the doctrine for which Julio De Vido was held in a case for state fraud. When the government appoints new magistrates, it controls more than half of the field.
