Lula got a court victory over Sergio Moro

Former President Luiz Incio Lula da Silva obtained an important victory on Tuesday before the Federal Supreme Court, the highest court in Brazil, which granted him for the most part the right to access the leaked messages of former judge Srgio Moro and Operation Lava prosecutors. Jato, with whom he seeks to overturn the sentences handed down against him due to the existence of the law and political persecution.

One of the magistrates accused Moro of having acted illegally as a sort of “Brazilian Stasi” by comparing her to the secret police of the dissolved East Germany.

The Second Chamber of the Supreme Court, by 4 votes to 1, rejected the appeal of the prosecutor and defense of Moro and the former chief of prosecutors of Lava Jato, Deltan Dallagnol, to withdraw the copy of Lula’s dialogues that have been captured by a hacker.

In the dialogues, for example, there are conversations to create causes for Lula and for example Moro, as a judge, guides prosecutors to gather evidence against Lula in order to convict him of corruption, forcing whistleblowers to be rewarded.

Even prosecutor Dallagnol called Lula “9” in his dialogues on the Telegram app and when the former president was convicted he celebrated by saying it was a “CIA gift” so that there was illegal exchange of information with Swiss prosecutors and the United States Department of Justice,

“This model of justice is that of a totalitarian state, which was complacent by the media. It’s like the New York Times said, it’s the biggest legal scandal in human history. It is full of crimes that reverberate around the world, ”Minister Gilmar Mendes said.

Mendes said that Moro and Lava Jato used the judiciary in the city of Curitiba as “the Stasi” to investigate judges from even higher tax courts, the Brazilian Afip, to divulge this information to friendly journalists and thus put pressure on them to ratify the decisions of the first instance.

This vote is seen as the prelude to the session on overturning the two convictions handed down by Lava Jato against Lula, who spent 510 days in prison and was disqualified from participating in the 2018 election won by Jair Bolsonaro.

In November 2018, Moro officially joined the Bolsonarismo and assumed the post of Minister of Justice on January 1, 2019, seeking a future place on the Supreme Court, but resigned in May 2020 due to disputes with Bolsonaro.

Judges Gilmar Mendes, Ricardo Lewandowski, Carmen Lucia and Kassio Nunes Marques voted in favor of Lula, the latter being the court judge appointed by President Bolsonaro, while Edson Fachin, who appears in the leaks, has been called against .as an ally of the prosecutor Dallagnol and judge Moro.

After the vote, former President Lula (2003-2010) revealed via social networks that he was released on Tuesday after being hospitalized on Saturday for bacteremia at Sirio Libans hospital in San Pablo, where he had been treated in 2012 for throat cancer.

The former president, 75, fell victim to COVID-19 at the end of the year after arriving in Havana, Cuba, where he was recovering before returning to Brazil in mid-January.
