The head of the AMP indicated that “HM sexually abused her daughter in houses located in La Guardia and in the city of San José del Rincón”. Added that “The crimes took place between August 2018 and April 2019, when the victim was young.”

He claimed that “the convict had committed his criminal acts on several occasions where he had been left in the care of the young girl”. In this regard, he noted that “due to the age difference between the two, the bond they have and the circumstances in which the sexual assaults took place, the events were enough to harm the health of the victim”.

Qualified offenses

Del Río Ayala explained that “Montaño has been convicted as perpetrator of seriously scandalous sexual abuse and of promoting the corruption of minors, two classified crimes (for bail, for guardianship and for coexistence)”.

On the other hand, the prosecutor reported that “Montaño admitted to having committed the crimes and his defense expressed his agreement with the criminal classification, the sentence imposed and the shortened procedure chosen to conduct the trial”. As mentioned, “relatives of the victim – who is still a minor – have also expressed their agreement with the decision.
