Last week, the national government implemented the new non-binary national identity document for people who do not perceive their gender as female or male. Yes indeed, Argentines can now enter an “X” to define their gender, both in the DNI and in the passport.

However, this expansion of rights can be accompanied by immigration problems: only a small number of states recognize a third category, so people dealing with non-binary DNI might have problems entering other countries.

From the National Register of Persons (Renaper), they explained that “national public administration agencies have 120 days to adapt regulations, systems and technologies for effective implementation and compliance with the decree”. As established in Decree 476/2021, Article 6 clarifies that the Ministry of Foreign Affairs, International Trade and Worship must notify the terms of the decree to the International Civil Aviation Organization (ICAO), in order to designate the countries which compose it accept the income, permanence and / or transit of non-binary Argentinian people.

The recommendation, for now, is “Check with the Ministry of Foreign Affairs and the consulate of the country you plan to visit before traveling in case they could possibly have restrictions entry, stay or transit in the countries of destination ”.

As it turned out, the Renaper will also inform people who wish to have a non-binary DNI that they should contact the Ministry of Foreign Affairs in advance in the event of a visit abroad.

For its part, the Embassy of the United States, one of the countries most frequented by Argentinian tourists, has warned that today there is no possibility of choosing an X when obtaining a ‘visa, so you have to choose yes or yes between the above options.

“Right now, only male and female gender options are available for a US visa applicant. Applicants should choose one or the other when preparing their visa application online. The sex reflected in the sex field of any visa issued must coincide with the sex reflected in the sex field of the applicant’s foreign passport, ”they explained to Bugle from the embassy.

“If a foreign passport does not include a gender / gender, male or female field, applicant must select male or female for visa application of the United States and, in such cases, the department usually issues the visa on the basis of the indication of the male or female chosen by the applicant, ”they added.

The Government itself has recognized in the text that there are very few countries in the world that allow the possibility of choosing a third gender option in an identity document: the Federal Democratic Republic of Nepal, the Islamic Republic of Pakistan, Bangladesh, India and Canada.
