“Stay in Mexico”: the Supreme Court of the United States ordered to reactivate a questioned immigration policy of Trump | Setback for President Joe Biden

Court order

However, in mid-August, Matthew Kacsmaryk, a federal judge from the district of Texas appointed by Trump, ordered the reinstatement of the program noticing that the Biden government rejected the benefits of this policy. Last Friday and following a request from Washington, Judge Samuel Alito ordered the temporary suspension of the reinstatement of the MPP and to give the government a few days to present the arguments which motivated its decision.

Finally Tuesday the judges ruled that Biden did not justify the end of the program and that its closure he had been “arbitrary and capricious”. In a brief unsigned order, the highest US court said the government’s “request” to suspend reinstatement was “denied”. The case will now go to an appeals court and can return to the tribunal, where six of its nine members are Conservatives.

Disagreement

The Department of Homeland Security (DHS), in charge of the American immigration system, said in a statement he “respectfully disapproves” of the district court’s decision and regretted that the Court “refused to pronounce a stay”. He also said he would comply with the order “in good faith” and has already started participating in diplomatic discussions with the Mexican government regarding the program.

The decision of the highest court has also been criticized by immigrant rights groups. The decision “is cruel to say the least”, Turning Yael schacher, Legal Advisor for the United States of Refugees International. “The Biden administration should not view this move as an order,” Schacher added.

For its part Omar Jadwat, member of the American Civil Liberties Union (ACLU), noted that democratic government “He was right to cancel” this policy, but indicated that now must “take all available measures to end this illegal program completely, including ending it with a fuller explanation”.

Camp
