A group of students of the Autonomous Technological Institute of Mexico (ITAM) is promoting an amparo to cancel the request of the government of Andrés Manuel López Obrador to cancel the work of New Mexico City Airport (NAICM).

The argument that supports the allegation of amparo is that once the new government – which took power on December 1 – took control of the decisions of the new airport, it is precisely the consultation that motivated the suspension of the work, and not the technical arguments..

The students indicated in their application that Javier Jiménez Espriú, Secretary of Communications and Transport, had declared before the Mexican Senate that the airport it was economically unfeasible and there were reasons of a technical nature that forced the new government to cancel the operation. However, these are not the same reasons as those used legally to suspend work.

This is not the first time that these students are filing for protection in order to avoid the airport cancellation. But in this first request the judge dismissed the amparo because López Obrador was still elected president, not in officeand you could not recognize any authority to make decisions.

At that time, the judge's decision also included a criticism of the consultation: he ensured that the investigation could have no legal consequence and "even less" a binding effect, the exercise had no "constitutional or legally recognized power".

But the subsequent trial was admitted because López Obrador, already president of Mexico, is a figure who has the power to conduct the consultation, still within the constitutional frameworks of the law.
