The Federal Prosecutor in the Vialidad case, Diego Luciani, was opposed on Tuesday to the trip of the former president Cristina Kirchner in Cuba, to visit his daughter Florence from 2 to 10 July, in an opinion to the Federal Oral Court 2 which will have the last word.
The dates on which Cristina would visit the Central American country, in the event of obtaining a judicial authorization, do not interfere with the scheduled hearings of the dispute.
Florencia Kirchner has been undergoing medical treatment in Havana since February. Although, in principle, she attended a seminar on film, the senator reported in mid-March that her daughter was suffering from post-traumatic stress disorder and that her health was deteriorating.
"After starting the debate hearing with the reading of the obligation of elevation to a trial, the reasons given for traveling (" personal reasons ") do not allow to move this position, and the presentation does not badyze either a change in circumstances of fact, or the existence of new reasons or additional reasons that could alter such an opinion, "said Luciani about the reason for the rejection.
"From another plan, although the dates chosen, in principle, should not overlap the hearings – which is considered positive -, it is certain that this party does not know whether under the planned holidays for July 8 and 9, the Court will modify or not modify the hearing schedule, as sometimes happens in similar cases ", he added.
He also remembered "the obligation of the accused to attend certain acts " as the reading of the charge that is being made, alludes to "the inability to conduct the trial in absentia (Article 290 of the CPPN) " and the obligation to "guarantee the validity of the principle of immediacy".
The opinion of the prosecutor does not bind the Federal Oral Court 2, which was now in a position to rule on this request.
