The majority of the Superior Court of Justice decided unanimously, the acceptance of the habeas corpus presented by the defense of former President Michel Temer.
According to information published by Folha de S. Paulo, the decision implies the release of Temer, held for preventive purposes in San Pablo.
During Tuesday's session, magistrates also granted habeas corpus to Joao Baptista Lima Filho, friend of Temer since the 80s, was one of the operators of the former president.
Both have obtained a free regime in which they must comply with certain precautionary measures, for example, stay in touch with other researchers, change addresses, leave the country and hold positions in the leadership of a party. The decision of the court is preliminary and was based on a criticism of the pre-trial detention, because the crimes allegedly charged were allegedly committed between 2011 and 2015. The politician was arrested on March 21st. after the prosecution accuses him of benefiting from bribes paid by various companies and to be the principal leader of a criminal organization which has diverted nearly $ 500 million of public resources for 40 years.
Temer took power in May 2016, when the process that led to the dismissal of the then President Dilma Rousseffwith which he served as vice-president and, on 1 January, pbaded the presidential band to Jair Bolsonaro.
