Before the imminent legalization of recreational marijuana use in Mexico, there are still a series of legal problems and loopholes, so that the transition from the illegal to the legal framework is going smoothly.
Given this budget, Infobae Mexico interviewed Rafael Soler Suástegui, an attorney specializing in civil obligations, legal philosophy and refugees, who responded to editorial concerns about the mass production of the herb in the country and the resulting social repercussions.
Infobae Mexico asked for a rough explanation of the restrictions that exist in agribusiness for the mass production of marijuana. In view of this, the professor also at the university The room explained that due to country conditions, there is a great potential for exploitation and therefore it is possible that the seed is genetically manipulated.
However, he was of the opinion that the licensing system for production must be renewed periodically due to the possibility that the product the tip may contain chemicals other than marijuana such as nicotine and tar, which are severely addictive. In view of this, it should be remembered that the addictive factor of tetra hydro cannabinol (THC), active substance of the plant, has a reduced dependency factor.
Regarding the production method, Infobae Mexico mentioned the possibility of transgenic single-cycle crops; that is, the plant that is cultivated does not produce seeds to continue harvesting, in this way, the farmer would be linked to the monopolistic supply of the seed producer.
To which he replied that there is still nothing established in terms of regulation and that the authorship of said seeds must be registered by Mexican Institute of Industrial Property (MAID). “There are varieties of vegetables, in this case like marijuana, that are protected by law. There are crops that could not be given without the permission of the creator of this plant variety “.
In this case, he recalled that Mexico is at an early stage of legislation and that the gaps that are not resolved are due to the fact that they had not been considered, since an illegal market is being legally transferred.
Regarding the possibilities of the world market, Soler Suástegui highlighted the conditions of Mexico, which are ideal for competing with giant producers of the world such as China; however, he clarified that he should establish trade alliances with other producing countries.
“China is the largest producer of medical marijuana in the world, so Mexico, if you want to be competitive, should establish trade alliances with other countries, like Canada. this is when you enter the export game “
Regarding security, teacher Soler explained that legalizing marijuana would not represent a significant damage to the coffers of drug traffickers. This is because he felt that they would continue to compensate for the losses represented by marijuana with other activities.. In view of this, one might understand the promotion of opiates or activities such as extortion.
The consequence he envisages, on the part of the state, is that be flexible compared to other medications, for example, he mentioned AMLO’s willingness to promote something in terms of Amapola.
In this perspective, the researcher de La Salle was asked about the possibility of extending an amnesty law for marijuana growers, under the argument of production by coercion of groups dedicated to the transfer of drugs, to which he replied that this is considered in a latent way, but there is still nothing conclusive.
“Although it exists in the word, nothing guarantees it”
Finally, he marked the differences between the process and the vision of AMLO in this regard, because although he understood that Mexico can be a great reference in the industrial production of marijuana, Soler Suástegui is convinced that for a regulation optimal, the sWe must create a specialized institute capable of dealing with the complex phenomenon of marijuana and not leaving everything to the National Institute Against Addictions.
“I don’t like creating bureaucracy, but there should be an independent institute for the regulation of marijuana. A specific entity that has the right attributes to be able to deal with the subject. In this case, there is a refusal by the government for budgetary reasons, ”he concluded.
