The prosecutor's office had asked for a 40-year sentence for the young woman because, according to her, "she was responsible for protecting her baby's life and did not prevent her from dying". A few minutes before hearing Judge Hernandez's decision, he told the court: "I'm innocent, check the evidence, let me continue my life, I just hope justice is done."

The young woman had been sentenced to 30 years in prison in 2017, but the Supreme Court annulled this sentence and ordered the trial to be repeated.
