From next Wednesday, September 1, Uruguay will allow the entry into the country of foreign landowners who can prove that they are vaccinated against COVID-19, including their relatives up to the second degree of consanguinity.
“The Executive Power published on Friday the decree 279/21, which establishes an additional exception to the partial closure of the borders currently in force, allowing the entry into the country of foreigners owners and holders of social participations or shares of persons legal entities and the final beneficiaries of real estate located in the country, who certify that they are immune to the COVID virus ”, explains Ricardo Domínguez, boss of Rica Consultores, specializing in tax procedures and legal residence of foreigners in Uruguay.
Among those permitted to enter, the decree includes the owner’s spouse or common-law partner, children, parents, grandparents, siblings and grandchildren.
However, there are a number of issues that are not yet entirely clear, as noted in the consultation. For example, in regulations Kinship by affinity must be included, like the one who binds one spouse with the blood relatives of the other, such as the in-laws, the daughter-in-law and the brothers-in-law.
“It is also necessary to analyze the patrimonial situation of a person who acquired the good in community of goods, but titled in the name of a single spouse, what happens to the relatives of the person who does not have the good to her name. Although the text does not expressly include it, they must also be considered as included, ”explains Domínguez.
Conditions for entering Uruguay
To enter the neighboring country, the conditions will be as follows:
* Owners must present a Notarial certificate issued by a notary public in Uruguay or make a sworn statement of goods in Uruguay.
2. Cases in which the owner of the property is a Legal person. Thus, the entry of natural persons who appear as associates of companies, shareholders and in the case of final beneficiaries resulting from the declaration filed with the corresponding Central Bank of Uruguay is permitted.
3. The owner of the property and his relatives must enter must demonstrate that they are immunized with a vaccine against COVID either one or two doses depending on the type of vaccine, approved by their country of origin, during the last six months before dispatch or arrival in the country and respecting the respective waiting periods to obtain effective immunity.
It makes sense that even the vaccine combination from different laboratories, provided that it is proven that it has received the corresponding doses and that it has completed the period of effectiveness to achieve immunity, and without the seniority exceeding six months.
4. In the case of foreign nationals under 18, who come from a country where no type of COVID vaccine has been approved for their age group, must adhere to administrative segregation of 7 days plus a negative swab or 14 day quarantine, and your family must keep the same isolation made by the minor.
5. Everyone should accredit a PCR test with a negative result before traveling, and they will not need to self-quarantine unless they are admitted with unimmunized minors under the age of 18, in which case all members must perform the corresponding quarantine.
6. It is important to have the affidavit formats to prove: owner, partner or shareholder or final beneficiaries of real estate in Uruguay and accreditation of persons immunized against COVID by the application of one or two doses as the case may be.
“It should be mentioned that so far the opening of the borders has not been ordered for immunized foreigners entering Uruguay after November 1, 2021. Obviously, the government is awaiting the evolution of infections and the development of the new Delta strain, ”adds Domínguez. President Luis Lacalle Pou had promised to proceed with this opening and if nothing negative happens, it is estimated that it will happen.
