Servcorp Small Business Contracts Are "Unfair"

The contracts entered into by Servcorp service provider with its small business tenants were found to be unfair and void, the Federal Court found.

Contracts automatically renewed the client's contract unless they unilaterally excluded the contracts, unreasonably limited Servcorp's liability and allowed Servcorp to retain the security deposits from customers they did not ask for their refund.

The court found that the contracts were unfair under undertaking a compliance program and paying the Australian Competition and Consumer Commission 150.0

The lawsuit was a coup in the burgeoning coworking sector, which now accounts for 0.6% of office space in Australian capitals.
