In compensation for his dismissal, the dismissed CEO Ulrich Schumacher claims 4.3 million euros from the lighting company Dornbirn Zumtobel in a civil case pending before the court Feldkirch. This is clear from Schumacher's complaint, Court spokeswoman Angelika Prechtl-Marte confirmed at the request.
The plaintiff Schumacher says that he was fired unjustly as CEO at the end of February. The 60-year-old manager justifies his financial claims with his CEO contract, which would expire in two years. The applicant decides on wages and bonuses. In addition, the 60-year-old man wants to be compensated for the risk of no longer finding a job as an equivalent manager. Civil Judge Norbert Stütler has not yet set a hearing date in the referral procedure.
Schumacher is conducting another civil case against Zumtobel in the Regional Court. The German complainant is fighting against his dismissal as CEO from the beginning of February by the Supervisory Board. In the pending recall proceedings, Judge Birgit Vetter set the value in dispute at 500,000 euros
Rest agreed
In the revocation process, the parties to the dispute agreed to a rest. If, after three months, one or both of the parties to the dispute request that the proceedings continue, negotiations resume. The suspension of the recall procedure has not been accepted for out-of-court settlements, but to wait if Judge Stütler joins his dismissal process with the dismissal process in one proceeding. For the moment, Judge Vetter has refused to include the dismissal procedure in her dismissal procedure. The defendant company has so far rejected the negotiations for a settlement.
The two proceedings deal largely with the same issues on which the plaintiff's and the defendant's Viennese lawyers are in agreement. In each case, it is checked whether the replacement of Schumacher was justified. In the process of dismissal, the plaintiff presented 34 witnesses
Several reasons
Four reasons invoked by the defendant company for the replacement of Schumacher: disruption of the relationship with the chairman of the Supervisory Board Jürg Zumtobel, lighting of the large Schumacher private car park in Germany Operating expenses, invoiced flight costs and approximately 20 commercial contracts concluded without the approval of the Supervisory Board.
