The employers of metallurgy announced Wednesday the signing of two new branch agreements "to develop employment" , one of which on the implementation of the "construction contract", as allowed by the ordinances reforming the Labor Code.
In a communique, the Union of the Industries and Metiers of the Metallurgy (UIMM) specifies to have signed these two agreements on June 29 with CFDT, CFE-CGC and FO.
CGT Métallurgie, the largest union in the industry – the largest in France with 1.4 million employees – did not sign them. The union, whose delegation has issued a "negative opinion", will make its final decision Thursday, after a consultation of its members, he told AFP.
Secretary General Frédéric Sanchez protested in March against the UIMM's "unilateral" inscription on the social agenda of a negotiation on the construction contract, against this "Grail for the employers".
Concluded for the for a three-year experiment, the agreement on the "construction or operation contract" meets, according to the UIMM, "new expectations of business leaders and employees."
The contract of construction site is a CDI hitherto mainly used in the construction sector, which can be completed once a construction site is completed.
The agreement distinguishes between companies with between 50 and 1,000 employees and those with more than 1,000 employees, according to the document consulted by AFP. In the first case, the number of construction site contracts may not exceed "more than 10%" of the workforce, in the second case "more than 5%".
The text also states that the minimum duration "may not exceed be less than six months "and sets the terms of a special severance pay, variable depending on the duration of the contract.
The second agreement signed reduces the length of the waiting period between two fixed-term contracts or temporary work contracts on one and the same position, at a quarter of the contract term, with a maximum of 21 days of absence.
It "aims to remove the barriers to employment" and "also allows employees to enrich their professional experience in the industrial sector", according to the UIMM.
Metallurgy is "the first branch to seize these provisions from the ordinances reforming the labor code ", underlines the employers of metallurgy.
