Guards and rail strike prevent trial. Free accused.
We have already seen suspects of very serious facts released because the examining magistrate who dealt with their case had forgotten to sign their arrest warrant.
Two missed appointments [19659005] This time, it was the prison guards' strike and the rail strike that led to the Brussels Criminal Court deciding to release an accused who was awaiting trial and who, twice, could not be transferred from his prison to the courtroom
The information was given Thursday by "Het Laastste Nieuws" and confirmed by the lawyer of a civil party.
Let's take things in order: Kenny D., a native of Hal, is being prosecuted for rape. He allegedly badually abused his girlfriend at the time on a number of occasions over a period of more than one year.
A second woman was allegedly abused by the suspect on August 27, 2017, while returning home after having spent the evening in Hal.
While awaiting trial, Kenny D. was incarcerated at Forest Prison.
At his first court appearance, Kenny D. sought and obtained a postponement because he had changed his lawyer. The case was therefore postponed until July 4.
On the day of the hearing, Kenny D. could not be transferred from Forest Prison because of the Guards' strike. The judge set a new date of appearance, July 11.
This time the hearing could not be maintained because of the strike of the SNCB. There was not enough staff available in the jail and courthouse.
The suspect's lawyer applied for provisional release because of the length of pre-trial detention of his client, who is in prison for over a year
The court granted this request. The case was once again postponed to November 9.
