President Biden is “ignoring” federal law with sweeping executive immigration orders he has signed since taking office, Texas Attorney General Ken Paxton said on Sunday, creating a “huge risk” for his state.

Paxton told Maria Bartiromo on “Sunday Morning Futures” that Biden was “out of control” and “overstepping his constitutional role” by signing the executive orders intended to roll back the Trump administration’s immigration policies.

“You have Democrats who control both the House and the Senate so he can make these changes,” Paxton said. “He does not have to issue edicts from above, ignoring federal law.”

Biden on Tuesday signed three more executive orders proposing changes to immigration, including the creation of a task force to advance the reunification of migrants separated from their family members at the border, a strategy to combat “migration irregular ”at the southern border, and one that will set up a review of Trump-era policies on legal immigration.

“I’m not making a new law, I’m eliminating bad policies,” Biden said of the Oval Office at the time.

Biden had previously signed executive orders that overturned Trump-era travel restrictions in countries deemed a security risk and sought to impose a 100-day moratorium on deportations.

Paxton was the first state attorney general to sue the Biden administration over the executive order proposing a 100-day break on evictions. The state seeks a permanent injunction while it challenges the merits of the case.

He said Biden’s executive decrees had effectively sent the message that America’s borders were open, creating risk for his state, which shares the larger border with Mexico.

He said Texas was already grappling with human trafficking, drug trafficking and gang issues on the border, adding that Biden’s orders would only increase the cost of policing, education and health in the state.

“It’s an unfunded tenure for my state and it’s really hard for us to gauge what it’s going to end up costing us,” Paxton said.
