Brasília, 27 (Agência Brasil) – Minister Edson Fachin of the Federal Supreme Court (FST) decided Wednesday to open an investigation into possible irregularities in the award-winning collaboration agreements signed by four J & O employees F. The Minister also decided that once the evidence collection phase (investigation) is completed, it will be up to the plenary of the Court to decide whether or not to approve the cancellation requested by the prosecutor's office. After hearing the reasons of the PGR for the cancellation of agreements and collaborators for maintenance, the minister stressed that it was important to gather evidence to guarantee the broad right of defense.
"That said, determine the continuation of the action with the parties to clarify, in the common five (5) day term, the evidence that they intend to produce, indicating, in the case of witnesses, qualification and updated addresses.To perform and conclude the investigation, after the final motives of the parties, I will indicate a question for judgment by the entire court ", said Fachin in a 62-page decision signed on Wednesday.
On September 14, 2017, the then Attorney General of the Republic, Rodrigo Janot, announced that he had decided to cancel the award-winning collaborative agreements concluded between the man and the man. At the time when Janot was still at the head of the PGR, the former prosecutor pointed out that the Joesley and Saud brothers had acted by omitting the alleged criminal charges involving Senator Ciro Nogueira and the involvement of the Former Attorney General Marcello Miller in the settlement.
"The case under examination requires a prior judicial demonstration of the cases reported by the public prosecutor as sufficient to terminate the agreement, which falls within the competence of the plenary of this STF" , wrote Fachin.

In December, the Attorney General of the Republic, Raquel Dodge, reinforced the petition for the end of the award-winning collaborations of Joesley and Ricardo Saud. In May this year, the Attorney General reinforced Fachin's request to approve the dismissal of Wesley and Francisco de Assis e Silva.
The executive agreements of J & F were approved by the STF on May 11th. Joesley involved President Michel Temer, recording a conversation between the two during a meeting at the Palacio do Jaburu.
The end of the Joesley and Saud collaborations was made by the PGR because the executives would have omitted "criminal facts" at the conclusion of the transaction.
