Federal agencies also pointed out that the Court of Auditors of the Union (TCU) recently recognized the legality of the auction in Judgment No 1199-1118. In addition, they indicated that the maintenance of subsidiaries under the control of Eletrobras would jeopardize the continuity of electricity supply in the states of Acre, Alagoas, Amazonas, Piauí, Rondônia and Roraima, where companies operate.

The judge of the second Teresina Federal Court of Justice, Márcio Braga Magalhães, even suspended the general meeting (AGE) held by the shareholders of the company and decided to privatize it. The action was proposed by the Union of Urban Planners of Piauí (Sintepi), who was able to prove to the court that the minutes of the meeting were rigged.

In Piauí, Sintepi's president, Paulo Sampaio, guarantees that day 17 will stop privatization if the federal government does not suspend the auction scheduled for July 26. The category should cross arms on July 25th and 26th.

Given the AGU, given the financial constraints of the Union and Eletrobras to make the necessary investments, subsidiaries, which depend on heavy investment of resources, are altered. According to AGU calculations last year, the six companies accumulated losses of R $ 4.5 billion and the operations are maintained by the Global Reversionary Reserve (GRIP). These resources will, however, have to be returned to the electricity system through rate adjustments.

AGU and BNDES also understand that if distributors are not sold, they should be regulated by Eletrobras.
