The rapporteur for action, Minister Jorge Mussi, said that for the abuse of power to be confirmed, it was necessary to prove the seriousness of the fact and its influence on the outcome of the poll.

"While there is no doubt that the act of coercion employed by the private sector can portray this abuse, it is essential to demonstrate a solid and concrete method, but this is not the case. not the case, "he said.

For the rapporteur, the evidence was insufficient to configure the abuse of power.

The vote was accompanied by Ministers Og Fernandes, Admar Gonzaga, Tarcisio Vieira and Luís Roberto Barroso. In addition to Fachin, the vote of the President of the Court, Rosa Weber, is missing.

At the beginning of the trial, lawyer Tiago Ayres, representing Bolsonaro, said that the opposition coalition "was asking for a lot", but little evidence of the allegations.

"There is no evidence of the participation of the elected president, there is no illicit," he said.

"There is no demand for a vote, there is no embarrbadment," said Hang's lawyer, Alisson Nichel.
