Britney Spears has lost her offer to immediately kick her father out of his guardianship – or even get an earlier hearing to try to do so, according to a report on Monday.
The former pop star had asked a California judge to bring her case forward from September, arguing the delay was causing her continued harm, TMZ said.
The judge rejected her offer, although “without prejudice,” meaning she can renew her attempt before next month, the outlet said.
The singer’s lawyer, Mat Rosengart, argued that Britney’s father, Jamie Spears, continued control over his client was harming her mental health.
“Sir. Spears’ removal as curator is essential to [Britney’s] emotional health and well-being and in the best interests of the conservatory, ”Rosengart wrote in court documents, according to TMZ.
“Each day that passes is another day of harm and preventable harm to Ms. Spears and the estate.”
Jamie Spears was granted guardianship of his daughter in 2008 after she suffered a horrific series of public collapses. The arrangement is granted when a person is considered to be mentally incapable of taking care of themselves.
The father is currently handling the financial end of his daughter’s affairs, while a court-appointed co-curator acts as his “caregiver”.
Rosengart argued that Jamie Spears’ handling of his daughter’s life was a threat to her long-term finances, according to TMZ.
In the file, Rosengart included a quote from Britney’s mother, Lynne Spears, to challenge her father’s intentions.
“It is clear to me that James P. Spears is unable to put my daughter’s interests ahead of his own, both professionally and personally,” the mother said in the quote.
