Britney Spears has lost her attempt to oust her father, James Spears, as her estate registrar – and the singer’s lawyer now says she won’t perform while he remains in office because she is afraid of him.

Los Angeles Superior Court Judge Brenda Penny on Tuesday refused to suspend Spears, widely known as “Jamie,” from the post he had held for the past 12 years. But she will consider future petitions for her suspension or dismissal from her post, according to the Associated Press, and she also granted the singer’s request that the Bessemer Trust, a trust company, be appointed co-curator.

The hearing was conducted by telephone and videoconference, on Los Angeles Times reports; the singer herself was absent but her two parents, Jamie and Lynne Spears, were present.
